Yes. One common belief is that a Ca Lemon Law claim must be brought within 18 months of purchase and 18,000 miles on the odometer. This belief is not true. A California Lemon Law claim may be brought at any time as long as there are warranty repairs and as long as the stature of limitations has not run on the claim. As such, California Lemon Law rights may be brought long after 18 months or 18,000 miles and even after the warranty has expired.

May I make a California Lemon Law claim if my product is not covered by a warranty?

No. The California Lemon Law covers only warranted products. A general rule – no warranty, no Ca Lemon Law claim.

Yes. The California Lemon Law will cover vehicles used or bought primarily for business purposes so long as the following criteria are met – (1) no more than 5 vehicles are registered in the business name; and (2) the vehicle has a gross vehicle weight less than 10,000 pounds.

Does the California Lemon Law only apply to safety defects with the product?

No. The California Lemon Law applies to defects in a product that substantially impair the product’s use, value or safety to the buyer. As such, non-safety related defects may qualify a vehicle for Ca Lemon Law relief. For example, a navigation system defect may be substantial to one who heavily relies upon the navigation system. A paint defect may substantially impair the value of the vehicle, or its use if repairs take an extraordinary amount of time to complete.

How long does a manufacturer/dealer have to complete warranty repairs?

The California Lemon Law requires that warranty repairs be completed within 30 days of the product’s presentation to the repair facility for warranty work.

Yes. The California Lemon Law does apply to motorhomes. The chassis and chassis cab of a motorhome are covered by the new motor vehicle portion of the lemon law, while the livable portion of the motorhome is covered by the consumer good portion of the lemon law.

Yes. The California Lemon Law has a one way fee shifting provision that requires the manufacturer to pay the consumer’s attorney’s fees and costs if the consumer prevails.
