The Manguson-Moss Federal Warranty Act is the federal lemon law and is found in US Code §§ 2301 et seq. Magnuson-Moss sets federal warranty standards which must be abided by if a product is placed within the stream of commerce. Magnuson-Moss provides for two types of warranties – full warranties and limited warranties. In general, full warranties provide for repurchase or replacement of a product if the product is not repaired after a reasonable number of repair attempts. Limited warranties merely provide for repair of the product. Most warranties are limited warranties.
Interestingly, Magnuson-Moss does not provide for a remedy if a limited warranty is breached. As such, some federal courts have held that state warranty law remedies apply to Magnuson-Moss in the event of a limited warranty breach.
Before a consumer may sue under Magnuson-Moss, he/she must first utilize an available arbitration program. The arbitration program must abide by certain federal standards which are found in the Code of Federal Regulations. The arbitration decision must be non-binding on the consumer, but binding on the warrantor if the consumer accepts the decision.
In California, for most lemon law cases, the California Lemon Law provides consumers with stronger protection than Magnuson-Moss. However, some situations exist in which the California Lemon Law may not apply but Magnuson-Moss does. And it should be noted that one is not required to utilize an available arbitration program prior to filing suit under the California Lemon Law.
